This Cookie Policy explains how ElimChat (a brand operated by DakyLabs, "ElimChat", "we", "us" or "our") uses cookies and similar technologies on the elimchat.com website, in the ElimChat web application and in the embeddable AI chatbot widget. It should be read together with our Privacy Policy, which describes in more detail how we handle personal data.

ElimChat is built with a cookieless-first philosophy. We do not use advertising cookies, profiling cookies or cross-site tracking technologies, and we do not sell your browsing data to anyone. The only cookie we set is a single essential session cookie required to keep you securely signed in to your account.

1. What are cookies and similar technologies

A cookie is a small text file that a website stores in your browser so that it can recognise your device on subsequent visits or requests. Cookies can be "first-party" (set by the site you are visiting) or "third-party" (set by another domain). "Similar technologies" include browser storage mechanisms such as localStorage and sessionStorage, as well as pixels, beacons and device fingerprinting. This policy covers all of these, regardless of the specific technical mechanism used.

Cookies are commonly grouped by purpose into four categories: strictly necessary (essential), functional/preferences, analytics/performance, and advertising/tracking. ElimChat only uses cookies in the strictly necessary category. We use no functional preference cookies, no advertising cookies and no tracking cookies.

2. Our cookieless-first approach

We deliberately designed ElimChat to minimise reliance on cookies and to avoid tracking visitors across sites. In practice this means:

3. The only cookie we use: the essential session JWT

When you sign in to your ElimChat account, we store a session token (a JSON Web Token, or "JWT") so that the application can keep you authenticated as you move between pages without asking you to log in on every request. This cookie is strictly necessary for the service to function: it carries your authenticated session, not your browsing behaviour, and it is never used for advertising or to track you across other websites.

Because this cookie is strictly necessary to deliver a service you have explicitly requested (logging in), it does not require your prior consent under the GDPR/ePrivacy framework or the equivalent rules in Ecuador's LOPDP and the other Latin American data-protection laws we align with. Blocking this cookie in your browser will prevent you from staying signed in and will break core functionality of the application.

4. Cookieless analytics (Cloudflare Web Analytics)

To understand aggregate traffic to our website (for example, how many people visit a page) we use Cloudflare Web Analytics, a privacy-first analytics product. Cloudflare Web Analytics is cookieless: it does not set any cookies, does not use localStorage, does not fingerprint visitors and does not collect personally identifiable information.

It provides us only with anonymous, aggregated metrics such as page views, referrers and approximate country of origin. Because no cookies or other client-side identifiers are stored on your device, and no personal data is collected for this purpose, this analytics does not require a consent banner. Cloudflare also acts as our CDN and reverse proxy; in that role it may process technical request metadata as described in our Privacy Policy, but it does not set tracking cookies on our behalf.

5. The embeddable chat widget sets no cookies

ElimChat is sold to businesses (the "Client") that embed our AI chatbot widget on their own websites. When one of your visitors interacts with the widget, the widget does not set any cookies on the visitor's device, and it does not use cookies or browser storage to track that visitor across other sites.

To deliver a conversation, the widget exchanges messages with our API and uses a short-lived, in-memory session reference that lives only for the duration of the chat. We do not store a persistent identifier on the visitor's browser for advertising or cross-site tracking purposes. Where we need to apply abuse and rate-limiting controls, we work with a hashed (pseudonymised) IP address rather than the raw IP. This means the widget can be embedded on third-party websites without adding cookie-consent obligations of its own for the cookies we control.

Note that the website hosting the widget (the Client's site) may set its own cookies for its own purposes, which are outside our control and governed by that website's own cookie and privacy policies.

6. No third-party tracking cookies

We do not load third-party advertising networks, social media tracking pixels or data-broker scripts that would set their own cookies through our website, application or widget. The third parties that help us run the service (our sub-processors, such as DeepSeek for AI inference, Resend for transactional email, Hetzner for hosting, Cloudflare for CDN/analytics and Qdrant for vector search) process data on our behalf as described in our Privacy Policy and do not set tracking cookies on your device through ElimChat.

7. Why you do not see a cookie consent banner

Cookie consent banners exist mainly to obtain consent for non-essential cookies — particularly analytics and advertising cookies. Because ElimChat uses only a strictly necessary session cookie and our analytics is cookieless, there are no non-essential cookies for which consent is required. For this reason we do not display a cookie banner. If we ever introduce cookies that require consent, we will update this policy and present an appropriate consent mechanism beforehand.

8. How to manage or block cookies

You can control and delete cookies through your browser settings. Most browsers let you view stored cookies, block all or third-party cookies, and clear existing cookies. Please note that if you block the essential session cookie described in section 3, you will not be able to stay signed in to ElimChat and parts of the application will not work.

9. Legal framework

This policy is written to comply with Ecuador's Ley Orgánica de Protección de Datos Personales (LOPDP) as our primary jurisdiction. It is also designed to meet the requirements of the EU General Data Protection Regulation (GDPR) and the ePrivacy rules, Brazil's LGPD, Mexico's LFPDPPP, Colombia's Law 1581, Peru's Law 29733, and the data protection laws of Argentina and Chile. Where any of these laws grants you stronger rights regarding cookies or tracking, those rights prevail.

10. Changes to this Cookie Policy

We may update this Cookie Policy from time to time to reflect changes in the technologies we use or in applicable law. When we make material changes, we will update the "Last updated" date at the top of this page and, where appropriate, notify you through the application. We encourage you to review this page periodically.
